Forward Regulatory Plan: 2020 to 2022

This Forward Regulatory Plan provides information on regulatory initiatives that the Public Service Commission of Canada (PSC) aims to propose or finalize in the next 2 years through:

  • pre-publication in the Canada Gazette, Part I
  • final publication in the Canada Gazette, Part II

Description

The current Locally-Engaged Staff Exclusion Approval Order excludes persons hired locally outside Canada from the entire operation of the Public Service Employment Act. The current Locally-Engaged Staff Employment Regulations prescribe an employment regime based on the framework of the former Public Service Employment Act.

The objective of this regulatory initiative is to modernize the current statutory instruments to align with the current Public Service Employment Act framework, while providing flexibility for hiring departments to operate within multiple jurisdictions.

This regulatory initiative is associated with the PSC’s stock review plan.

Consultations

The departments that employ persons locally, Global Affairs Canada and the Department of National Defence, are consulted regularly. The Office of the Chief Human Resources Officer is also consulted on this regulatory proposal.

Review of the Public Service Employment Regulations (Associated with the stock review plan)

Review of the Public Service Employment Regulations

Description

The Public Service Employment Regulations expand on the operation of the Public Service Employment Act by giving effect to certain provisions relating to matters under the Public Service Commission’s jurisdiction.

The objective of the review is to ensure that the regulations stay relevant to the current and emerging needs of hiring organizations, and to remove any unnecessary requirements.

This regulatory initiative is associated with the PSC’s stock review plan.

There are no expected impacts on Canadians, nor on businesses.

 

Consultations

In 2018–19, the Public Service Commission held a number of consultations with stakeholders. These initial consultations led to the development of a proposed model. New rounds of consultations were held in early 2020 to seek stakeholder feedback on the proposed model.

2018

Review of the Public Service Official Languages Exclusion Approval Order and related regulations (Associated with the stock review plan)

Review of the Public Service Official Languages Exclusion Approval Order and related regulations.

Public Service Employment Act

 

Description

The Public Service Official Languages Exclusion Approval Order and the Public Service Official Languages Appointment Regulations enable excluded persons to be subject to a non-imperative appointment on the basis of merit, except with respect to official language proficiency. These statutory instruments were created to provide a balance between ensuring that appointees meet the official language proficiency requirements of bilingual positions and fostering the access of unilingual Canadians to bilingual positions in the federal public service.

The regulations will be reviewed to assess their effectiveness and ensure they remain relevant and aligned with evolving legislation, policy objectives and priorities.

This regulatory initiative is associated with the PSC’s stock review plan.

2020

Repeal of the Communications Security Establishment Exclusion of Positions and Employees Approval Order and related appointment regulations (Associated with the stock review plan)

Title of regulatory initiative

Repeal of the Communications Security Establishment Exclusion of Positions and Employees Approval Order and related appointment regulations.

Public Service Employment Act

 

Description

These statutory instruments exclude all positions and employees of the Communications Security Establishment (CSE) from the application of the Public Service Employment Act and enable the Deputy Minister of National Defence to appoint persons to the CSE as deemed appropriate.

Since the coming into force of the National Security Act, the Chief of CSE was conferred exclusive appointment authorities. As a result, the exclusion approval order and related appointment regulations are no longer needed.

This regulatory initiative is associated with the PSC’s stock review plan.
