Application for Determination or Declaration
What kinds of application for determination or declaration can be made?
An artist, an artists' association, a producer or a producers' association can ask the Board to consider and decide on a variety of questions.
Examples of determinations or declarations that can be requested
Applications for determination or declaration by an artist
- to determine whether a right or benefit under an individual contract between an artist and a producer is more favourable to that artist than the provisions of the scale agreement which applies to the engagement (section 33).
Applications for determination or declaration by an artists' association
- to determine what rights, privileges and duties an artists' association has acquired as a result of a merger, amalgamation or transfer of jurisdiction among associations (section 30);
- whether pressure tactics are being applied by a producer in contravention of the Act (section 48).
In the case of a question arising during an arbitration proceeding, only the arbitrator or arbitration board can apply to the Board for a determination of the question.
Applications for determination or declaration by a producer or producers' association
- whether pressure tactics are being applied by an artists' association in contravention of the Act (section 47).
