Forward Regulatory Plan 2021-2023: Vaping Products Reporting Regulations

Title of Regulatory Initiative

Vaping Products Reporting Regulations

Enabling Act

Tobacco and Vaping Products Act

Description

The objective of the proposed Vaping Products Reporting Regulations is to require manufacturers and importers of vaping products to provide timely and relevant information on their vaping products to Health Canada, which would then be used to inform the development of policies and regulations. Mandatory public disclosure of information by the Minister as well as measures to enhance compliance with the reporting requirements would also be included in the regulatory proposal.

Regulatory cooperation efforts (domestic and international)

Not Applicable

Potential impacts on Canadians, including businesses

This proposal would affect manufacturers and importers of vaping products (vaping devices and substances) who would be required to prepare reports that must be submitted to the Minister of Health. This proposal is not expected to directly affect Canadian consumers.

There are no expected impacts on international trade or investment, since this is not a pre-market approval process.

Consultations

Health Canada consulted Canadians on the proposed Vaping Products Reporting Regulations through the publication of a consultation paper, which was published for public comment on Canada.ca in August 2017, and lasted 60 days.

A summary of the consultation has been published in a What We Heard Report: Consultation summary: proposals for the regulation of vaping products.

Canadians will have the opportunity to provide input on the regulatory proposal during the Canada Gazette, Part I, public comment period, which is expected to take place in winter 2022 and last 75 days.

Information on previous consultations and details on upcoming opportunities for consultation in the area of tobacco and vaping can be found on the Canada.ca website.
