Description
Health Canada is proposing to formalize the June 7, 2021, Interim Order Respecting Ultraviolet Radiation-emitting Devices and Ozone-generating Devices (IO) in effect for one year from the Canada Gazette, Part II, publication on June 26, 2021.
The IO and this regulatory amendment bring certain ultraviolet radiation-emitting (UV devices) and ozone-generating devices under the Pest Control Products Act (PCPA). These devices are marketed to control or kill bacteria, viruses including SARS-CoV-2 (the coronavirus that causes COVID-19 disease), and other microorganisms on surfaces, on objects, in water or in air.
Regulatory cooperation efforts (domestic and international)
This initiative is not part of a formal regulatory cooperation work plan.
The United States Food and Drug Administration have advised the public on the health risks associated with these devices and the Environmental Protection Agency have advised that false or misleading claims about their safety or efficacy, including their use on SARS-CoV-2, the virus that causes COVID-19, may subject the seller or distributor to penalties.
Potential impacts on Canadians, including businesses
By bringing certain UV and ozone-generating devices under the PCPA, these devices would need to be registered or otherwise authorized to be on the Canadian market, and require sufficient evidence to demonstrate that they can be used safely or that they work as claimed.
These requirements are needed to protect the health and safety of Canadians from the risks posed by unauthorized UV and ozone-generating devices.
Consultations
Health Canada engaged stakeholders and the public on the IO in spring 2021.
Health Canada published a Notice of Intent on the proposed regulatory changes for consultation in Canada Gazette, Part I, in December 2021.
Health Canada plans to seek an exemption from pre-publication in the Canada Gazette, Part I, and if approved, publish the final amendments in Canada Gazette, Part II, in spring 2022.
