Description

Amendments to the Regulations Amending the Regulations for the Monitoring of Medical Assistance in Dying (MAID) reflect amendments to the Criminal Code arising from An Act to amend the Criminal code (medical assistance in dying).

The amendments align the reporting requirements with the new legislative requirements including changes in eligibility for MAID; new or revised safeguards; collection of data with respect to race, Indigenous Identity and disability; and broadening reporting requirements to include all requests for MAID.

This initiative is not part of a formal regulatory cooperation work plan.

These amendments clarify reporting requirements for health care professionals involved with the assessment and provision of MAID, following recent legislated amendments.

Consultations

Health Canada published the proposed changes in the Canada Gazette, Part I, on May 21, 2022 with a 30-day public comment period.

Health Canada plans to publish the proposed changes in the Canada Gazette, Part II in fall 2022.
