Description
Health Canada is proposing amendments to the Surface Coating Materials Regulations to further increase the protection to infants and children from exposure to lead, improve alignment with major trading partners, and reduce regulatory burden on industry.
Health Canada is also proposing advancing consequential amendments for other regulations under the Canada Consumer Product Safety Act to align terminology and requirements for stickers, films and other similar materials and surface coating materials applied to certain consumer products.
This regulatory initiative is part of Health Canada's Regulatory Stock Review Plan.
Regulatory cooperation efforts (domestic and international)
This initiative is not part of a formal regulatory cooperation work plan.
The proposal aligns with the United States requirements for lead in surface coating materials and applied surface coating materials.
Potential impacts on Canadians, including businesses
It is anticipated that the proposed regulations would increase the protection to infants and children from exposure to lead.
Impacts on industry are anticipated to be minimal due to efforts to align internationally and reduce regulatory burden.
Consultations
Canadians had the opportunity to provide comments on the regulatory proposal during the Canada Gazette, Part I, public comment period, which started on April 24, 2021 and lasted 70 days.
The publication of the final Regulations Amending Certain Regulations Made Under the Canada Consumer Product Safety Act (Surface Coating Materials) in the Canada Gazette, Part II, is expected to take place in spring-summer 2022.
