Governor in Council regulations made under the College of Immigration and Citizenship Consultants Act
Enabling Act: College of Immigration and Citizenship Consultants Act (enacted by the Budget Implementation Act 2019, no. 1)
Description
Regulations are being developed to support the College of Immigration and Citizenship Consultants Act. Regulation topics include:
- A victim compensation fund;
- Function and powers of the Registrar;
- Functioning of the College’s complaints and discipline process;
- Ministerial powers with respect to the College, including circumstances for appointing a temporary administrator;
- Governance topics, including parameters for conflict of interest of board and committee members, eligibility criteria of board members, and College reporting requirements.
Regulatory cooperation efforts (domestic and international)
IRCC officials have engaged with provinces and territories to provide an overview of the College of Immigration and Citizenship Consultants Act and to proactively notify where possible consequential amendments may need to be made to provincial/territorial legislation or regulations. As part of regulatory cooperation efforts, IRCC officials are also discussing with provinces and territories the nexus between the federal College of Immigration and Citizenship Consultants Act and provincial legislation dealing with labour recruiters.
Potential impacts on Canadians including businesses
The proposed regulations for the College of Immigration and Citizenship Consultants will apply to the immigration and citizenship consultant profession. The regulations are expected to have an impact on the profession, as well as those who interact and conduct business with immigration and citizenship consultants.
Consultations
The anticipated date for pre-publication of the regulations for the College of Immigration and Citizenship Consultants in the Canada Gazette, Part 1, is winter 2022.
