Regulatory Initiative: Low-impact Amendments to the Radiocommunication Regulations

Description

The Radiocommunication Regulations are part of the regulatory framework used to manage the radio frequency spectrum in Canada. The objective of the amendments to the Regulations is to improve clarity, address issues identified by the Standing Joint Committee for the Scrutiny of Regulations, and update obsolete and unnecessary references contained within. More specifically, the amendments will:

  • Update the static reference to the Licence-exempt Radio Apparatus Standards List, October 2013 in Section 15 to include newly published radio standards specifications;
  • Clarify language related to Ministerial issuance of orders related to interference other than harmful interference in Section 52; and,
  • To ensure the accuracy of information in the Regulations, remove and update relevant sections related to examination fees that are no longer collected and certificates that are no longer issued by the Department.

The proposal is unrelated to a work plan or commitment under a formal regulatory cooperation forum.

Potential impacts on Canadians, including businesses

There are no expected business impacts.

Consultations

This is a low impact regulatory amendment. As such, public consultation will not be required and ISED will recommend foregoing prepublication in Part I of the Canada Gazette.

It is expected that this regulatory proposal will be published in Part II of the Canada Gazette in spring 2020.

Regulatory Initiative: Licence Fee Modernization Amendments to the Radiocommuncation Regulations

Description

The Radiocommunication Regulations are a part of the regulatory framework used to manage the radio frequency spectrum in Canada. Radio licence fees are set in those regulations. This initiative proposes to encourage the efficient use of spectrum by replacing an outdated fee schedule for certain radio licences with a simple and relevant fee model, providing more flexibility in terms of licence durations, and removing unused and obsolete fees.

The objective will be to:

  • encourage the appropriate use of the limited spectrum resource;
  • reflect the relative utility of different spectrum bands with a view to rewarding spectral efficiency;
  • facilitate network deployment in rural and remote areas; and
  • provide greater flexibility to licensees in terms of radio licence durations.

The proposal is unrelated to a work plan or commitment under a formal regulatory cooperation forum.

Potential impacts on Canadians, including businesses

As there will be business impacts, the small business lens applies to this proposal. The "One-for-One" Rule does not apply to this proposal, as no changes to administrative burden is expected.

Consultations

A preliminary Consultation on the proposed changes to the fees was held in fall 2018. The Decision resulting from this consultation was published in summer 2019. It is expected that this regulatory proposal will be pre-published in Part I of the Canada Gazette in summer 2020, to allow for further public comment.
