Forward Regulatory Plan: 2019 to 2021 – Miscellaneous Amendment Regulations

Description
On 28 August 2019, the National Energy Board became the Canada Energy Regulator (CER). Regulations made under the National Energy Board Act remain in force under the Canadian Energy Regulator Act (CER Act) until they are repealed or others made in their stead. New regulations and updates to existing regulations are being implemented through a phased approach.

Amendments to several regulations will be made to align names and terms with the CER Act. References to “the Board” in the regulations would be amended to either the “the Regulator” or “the Commission” depending on the individual requirement. The regulations included in this proposal are:

In addition, the Standing Joint Committee for the Scrutiny of Regulations (SJCSR) 2013 review of the Regulations Amending the National Energy Board Onshore Pipeline Regulations identified a number of administrative items to be addressed, including minor clarification on technical terms and clarification on the application of management system elements. Amendments will be made to address the items identified by the SJCSR.

These regulatory changes are non-substantive in nature and will be brought forward through the Miscellaneous Amendments Regulations process.

Regulatory cooperation efforts (domestic and international)
The proposed amending regulations are not being introduced to comply with, or have an impact on, any domestic or international agreement. There are no expected regulatory cooperation efforts needed.

Potential impacts on Canadians, including businesses
There are no expected impacts to Canadians or businesses.

Consultations
These are minor amendments and create no impact to stakeholders and the public. Through the Treasury Board Secretariat’s Miscellaneous Amendment process, the amended regulations will be published in Canada Gazette, Part II, with no consultation period. Communication on this matter will occur on the CER’s Consultation and Engagement webpage.
