Regulatory Initiative: Regulations amending the Canadian Cultural Property Export Control List - Canadian Heritage
Description of the objective
The Department of Canadian Heritage is considering increasing the fair market value thresholds in some of the groups within the Canadian Cultural Property Export Control List (Control List). The Control List groups under review are:
- Group I, Objects recovered from the soil or waters of Canada (minerals and fossils only);
- Group IV, Objects of applied and decorative art; and,
- Group V, Objects of fine art.
Description of the Regulation: The Control List describes the types of cultural property that require a cultural property export permit. The fair market value of an object is one of the key elements in deciding whether an object is on the Control List.
The proposed amendments will be of interest to businesses that export cultural property, as increases in fair market value thresholds will eliminate the requirement to apply for an export permit for objects whose value is below the newly established limit.

Public consultation opportunities
It is anticipated that Canadians will have the opportunity to submit comments during the Canada Gazette, Part 1 public comment period, which could take place in the spring of 2019 and last 30 days. Information on upcoming consultations can be found on the Consulting with Canadians website.
