Description

The proposed amendment would remove the requirement for Treasury Board approval of the timing and amounts of advance payments to reduce the burden on departments that is associated with administering large contracts.

The proposed amendment would require three coordinating amendments to remove the permissive clauses regarding advance payments and progress payments, and to remove the definitions of these terms.

The proposed amendment would make technical changes to update the title of the Intelligence Commissioner, and to replace the terms “fournitures” and “marché de travaux publics” in French with “biens” and “marché de construction” to align with the terms that are used in the federal government’s procurement policies and in Canada’s trade agreements.

The proposed amendment would exclude contracts approved by or directed by a court or an administrative tribunal since there is no opportunity to compete these contracts.

There would be no direct impact on Canadians, including businesses.

Consultations

All departments are being consulted on the proposed regulations.
No public consultations are planned as the proposed regulations are to reduce the administrative burden on departments, to make technical amendments, and to streamline the application of the regulations.
